Delaware Pedestrian Accidents
A pedestrian crash can have serious and long-term consequences for victims. While we all encounter pedestrians every day and we are pedestrians ourselves at some point, we sometimes fail to appreciate the dangers and risks of a pedestrian accident. According to statistics from the Delaware Department of Transportation, more than 80% of pedestrians involved in accidents across our state will also be hurt in those accidents. In the immediate aftermath of a crash, the pedestrian can face a long road to recovery with injuries that are often serious and can require extensive and long-term medical care.
Following an accident, it is important for injured pedestrians to take action in order to protect their legal rights. Under Delaware law, accident victims have three years to bring a claim against the other driver. However, victims should not hesitate to begin enforcing their rights just after the accident. If the other driver was at least partially at fault for the collision, then the victim may be entitled to some recovery. The exact value of the case can only be determined by consulting with an experienced attorney.
